din  14.11.2006
de cooperare în domeniul protecţiei proprietăţii
industriale între Agenţia de Stat pentru Proprietatea
Intelectuală a Republicii Moldova şi Oficiul de
Brevete al Republicii Bulgaria*

    Agenţia de Stat pentru Proprietatea Intelectuală a Republicii Moldova şi Oficiul de Brevete al Republicii Bulgaria, numite în continuare Părţi;
    dorind să dezvolte cooperarea de afaceri, ştiinţifică şi tehnică între Republica Moldova şi Republica Bulgaria, şi
    recunoscând importanţa ascendentă a tuturor aspectelor de protecţie a proprietăţii industriale asupra dezvoltării relaţiilor de piaţă în economiile celor două ţări,
    au convenit următoarele:
Articolul 1
    Părţile vor întreprinde măsurile necesare pentru a dezvolta şi extinde relaţiile sale reciproc avantajoase prin schimb de experienţă şi asistenţă în domeniile de interes comun.
Articolul 2
    Cooperarea dintre părţi va fi axată pe următoarele domenii de activitate:
    1. Schimb  de  publicaţii  oficiale  şi  acte  legislative  în  domeniul proprietăţii industriale.
    2. Schimb de informaţii referitor la:
    - Protecţia invenţiilor, designului industrial, mărcilor şi denumirilor de origine, soiurilor de plante şi rase de animale;
    - Realizarea drepturilor de proprietate industrială (brevete, mărci, design industrial);
    - Sistemele computerizate şi tehnologiile informaţionale utilizate în cadrul oficiilor Părţilor;
    - Promovarea proprietăţii industriale, acces la informaţie, inclusiv servicii informaţionale în domeniul proprietăţii industriale   prestate sectorului industrial.
    3. Perfecţionarea specialiştilor (personalului tehnic, juridic şi administrativ).
Articolul 3
    Activităţile specifice domeniilor principale de cooperare precum şi metodele de realizare ale acestora (schimbul de informaţii, consultaţii, seminare bilaterale, trening-uri practice reciproce) vor constitui subiectul unor planuri de lucru separate.
Articolul 4
    Cheltuielile legate de realizarea prezentului Acord sunt suportate de oficiile ambelor Părţi în baza planurilor de lucru, în care sunt specificate obligaţiunile financiare ale fiecăreia dintre Părţi, având ca principiu de bază - principiul reciprocităţii.
Articolul 5
    Părţile se vor întruni cu regularitate pentru a discuta implementarea şi actualizarea Acordului; aceste întruniri se vor convoca cel puţin o dată la doi ani în Republica Moldova şi Republica Bulgaria, alternativ. Rezultatele întrunirilor vor fi oficializate în procese-verbale. Limba de lucru este limba engleză.
Articolul 6
    Părţile de comun acord pot introduce modificări şi completări în prezentul Acord, care vor intra în vigoare în conformitate cu procedurile de intrare în vigoare a Acordului.
Articolul 7
    Prezentul Acord nu afectează drepturile şi obligaţiile Părţilor care decurg din alte tratate bilaterale sau multilaterale la care sunt Părţi.
Articolul 8
    Toate diferendele care pot apărea în urma implementării prezentului Acord vor fi soluţionate prin consultări bilaterale.
Articolul 9
    Prezentul Acord intră în vigoare la data semnării.
    Prezentul Acord se încheie pentru un termen de 5 ani şi acţiunea lui se va prelungi în mod automat pentru perioade consecutive de 5 ani, dacă nici una dintre Părţi nu va notifica, prin canale diplomatice, cu cel puţin trei luni înainte de expirarea termenului curent de acţiune, despre intenţia sa de a-l denunţa.
    Semnat la Chişinău, la 14 noiembrie 2006, în două exemplare originale, fiecare în limbile bulgară, moldovenească şi engleză, toate textele fiind egal autentice. În cazul apariţiei unor divergenţe, textul în limba engleză va fi de referinţă.

AGREEMENT
between the State Agency on Intellectual Property
 of the Republic of Moldova (AGEPI) and the Patent Office
 of the Republic of Bulgaria for cooperation in the field of
industrial property protection
    The State Agency on Intellectual Property of the Republic of Moldova and the Patent Office of the Republic of Bulgaria, hereinafter referred to as "the Parties",
    Wishing to develop the business, scientific and technical cooperation between the Republic of Moldova and the Republic of Bulgaria, and
    Rendering due account to the increasing importance of all matters related to the protection of industrial property under the conditions of establishing market relations in the economies of both countries,
    Agree as follows:
Article 1
    The Parties shall take all possible steps to develop and extend their mutually beneficial relations through exchange of experience and assistance on matters of common interest.
Article 2
    The cooperation between the Parties shall be carried out along the following lines of activity:
    1.    Exchange of official publications and legal acts in the field of industrial property;
    2. Exchange of information on:
    - Protection of inventions, industrial designs, trademarks and appellations of origin, plant varieties and animal breeds;
    - Enforcement of industrial property rights (patents, trademarks, industrial designs);
    - Computerized systems and information technologies used within the Offices of the Parties;
    - Promotion of industrial property, access to information, including industrial property information services for industry;
    3. Training and upgrading of the personnel (for technical, legal   and administrative staff).
Article 3
    Specific activities on the basic lines of cooperation and forms of realization thereof (information exchange, consultations, joint seminars, reciprocal practical training) shall be subject to separate working plans.
Article 4
    The costs related to the implementation of this Agreement shall be born by the Offices of both Parties according to the working plans, wherein, the financial obligations of each Party shall be specified, having as a basic principle - the principle of reciprocity.
Article 5
    The Parties shall meet regularly to discuss the implementation of and update the Agreement; these meetings shall be held at least once in two years in the Republic of Moldova and in the Republic of Bulgaria, alternatively. The results of the meetings shall be legalized in protocols. The working language is English.
Article 6
    The Parties, subject to mutual consent, may operate amendments and completions to the present Agreement, which shall become effective according to the proceedings provided for entering into force of the Agreement.
Article 7
    The present Agreement shall in no way affect the rights and obligations of the Parties resulting from the bilateral or multilateral treaties to which they are part..
Article 8
    The Parties shall settle all disputes that may arise upon the implementation of the Agreement thereof, through bilateral consultations.
Article 9
    The present Agreement shall enter into force on the day of its signature. The present Agreement is concluded for a period of five years and its action shall be prolonged automatically for furthor periods of five years, unless one of the Parties notifies, through diplomatic channels, of its intention to terminate it, at least three months prior to the expiration of the current validity term.
    Signed at Chişinău on 14.11.2006, in two original copies each in Moldavian, Bulgarian and English, all texts being equally authentic. In case of any divergence the English text shall prevail.
