ÎNTRE MINISTERUL APĂRĂRII AL REPUBLICII MOLDOVA ŞI MINISTERUL APĂRĂRII AL REPUBLICII SLOVACE CU PRIVIRE LA COLABORAREA ÎN DOMENIUL MILITAR* | |

______________________ *Semnat la Chişinău la 17 august 2005. În vigoare din 23 martie 2006. Ministerul Apărării al Republicii Moldova şi Ministerul Apărării al Republicii Slovace, denumite în continuare Părţi, reieşind din situaţia politico-militară actuală şi efortul ţărilor şi organizaţiilor internaţionale de a contribui la ameliorarea securităţii şi menţinerea păcii în lume, pornind de la efortul de a crea baza legală în domeniul colaborării militare în ambele state, care va extinde şi va ameliora colaborarea în conformitate cu principiile respectării depline a drepturilor omului, suveranităţii şi egalităţii ambelor state, creând o nouă formă de colaborare, înţelegere şi toleranţă a Părţilor, respectând legislaţia lor internă, dreptul şi cutuma internaţională, precum şi Carta Organizaţiei Naţiunilor Unite şi documentele privind pacea, ce rezultă din ea şi se referă la sarcinile colaborării în domeniul militar, dezvoltând activităţile din cadrul Programului Parteneriat pentru Pace în scopul integrării în structurile europene de securitate, au convenit asupra celor ce urmează: Articolul 1
În scopul interpretării şi implementării prezentului Acord, noţiunile au următoarea semnificare:Definirea noţiunilor a) Partea oaspete semnifică Partea, care detaşează o delegaţie cu autorizarea sa în conformitate cu prezentul Acord pentru a vizita cealaltă Parte; b) Partea gazdă semnifică Partea, care primeşte delegaţia celeilalte Părţi. Articolul 2
Părţile, călăuzindu-se de principiile egalităţii, parteneriatului şi avantajului reciproc, îşi vor extinde şi aprofunda colaborarea în următoarele domenii:Domeniile de colaborare 1. Consultări cu privire la securitatea militară şi misiunile politicii militare, consolidarea securităţii şi credibilităţii în lume. 2. Schimb de informaţie, opinii şi experienţă cu privire la dezvoltarea armatei. 3. Structura de organizare a armatelor Părţilor şi documentele lor. 4. Activitatea operativă în asigurarea cu informaţie a administrării de stat şi pregătirea teritoriului statului pentru apărare. 5. Calificarea şi cerinţele profesionale faţă de soldaţii ce urmează a fi încadraţi în funcţii. 6. Instruirea specialiştilor de specialităţi militare individuale, instruirea şi pregătirea lor. 7. Schimb de experienţă în problemele ştiinţei militare, dezvoltării tehnice, deservirea şi reparaţia bunurilor militare. 8. Sisteme de informare şi comunicare în armatele Părţilor. 9. Schimb de informaţie şi experienţă în domeniul cazării şi investirii în construcţie, precum şi în domeniul administrării şi deservirii proprietăţii imobile. 10. Protecţia mediului înconjurător la obiectivele de instruire militară. 11. Activităţile armatelor pe timp de pace şi desfăşurarea lor în caz de situaţii excepţionale. 12. Pregătirea în instituţiile de învăţămînt militar. 13. Schimb de informaţie în domeniul relaţiilor militare cu publicul, precum şi în domeniul controlului democratic asupra armatei. 14. Schimb de informaţie în domeniul serviciului medico-militar. 15. Activitatea de redactare şi editare. 16. Acţiuni de protejare a informaţiei militare secrete. 17. În alte domenii stabilite de comun acord între Părţi. Articolul 3
1. În baza prezentului Acord şi în scopul implementării acestuia, organele competente ale Părţilor vor încheia Protocoale separate de colaborare bilaterală.Formele de colaborare 2. Detaliile colaborării bilaterale vor fi precizate după cum urmează: a) schimb de propuneri asupra planurilor de colaborare bilaterală pentru anul următor până Ia 15 noiembrie a anului curent; b) aprobarea propunerilor şi definitivarea planurilor anuale se va efectua de către grupul de lucru comun al ambelor ministere până la 15 decembrie ale anului curent; c) în fiecare plan anual de colaborare bilaterală urmează a fi definite activităţi concrete, forma de participare, termenele, locul de desfăşurare, organul responsabil de organizare a activităţii; d) propuneri privind planul şi corespondenţa necesară pregătirii şi realizării lui se vor expedia prin canale diplomatice obişnuite. 3. În domeniile menţionate în articolul 2 al prezentului Acord colaborarea se va realiza în următoarele forme: a) întrevederi ale miniştrilor apărării ai Părţilor, a şefilor Marilor State Majore, comandanţilor sau locţiitorilor, altor reprezentanţi ai Părţilor; b) vizite ale ofiţerilor de stat major şi experţilor; c) întruniri ale reprezentanţilor instituţiilor militare, colaborare între unităţile militare; d) vizite reciproce legate de demonstrarea echipamentului, armamentului şi instruirii militare; e) vizite ale membrilor forţelor aeriene şi altor elemente ale armatelor; f) schimb de lectori ai instituţiilor de învăţământ militar; g) discuţii, consfătuiri, întâlniri, participarea la cursuri, simpozioane şi conferinţe; h) schimb de ziare, reviste şi altă producţie a presei şi cinematografiei cu generic militar; i) vizite ale echipelor sportive şi grupurilor culturale. Articolul 4
Finanţarea activităţilor ce ţin de realizarea colaborării militare se va efectua în bază de reciprocitate şi avantaj reciproc în conformitate cu legislaţia internă a Republicii Moldova şi a Republicii Slovace.Finanţarea colaborării Articolul 5
1. Partea gazdă va suporta cheltuielile legate de asigurarea membrilor delegaţiei Părţii oaspete cu:Atribuţiile Părţii gazdă a) cazare, alimentare şi transport pe teritoriul statului Părţii gazdă; b) plată pentru conferinţe, simpozioane şi alte întruniri; c) serviciile de translare în cadrul întrunirilor în limba, care va fi convenită de ambele Părţi; d) program cultural. 2. Partea gazdă va asigura membrii delegaţiei Părţii oaspete cu: a) asistenţa medicală de urgenţă în instituţiile medico-militare sau civile în aceleaşi condiţii ca şi pentru cetăţenii statului Părţii gazdă; b) conlucrarea necesară în caz de deces a unui membru al delegaţiei Părţii oaspete. Toate serviciile medicale şi transportul decedatului spre statul Părţii oaspete vor fi suportate de Partea oaspete. Articolul 6
1. Partea oaspete va suporta cheltuielile legate de asigurarea membrilor delegaţiei Părţii oaspete cu:Atribuţiile Părţii oaspete a) şederea membrilor delegaţiei pe teritoriul statului Părţii gazdă, cu excepţia costurilor suportate de Partea gazdă, menţionate în articolul 5 al acestui Acord; b) transportul spre locul stabilit anterior unde persoanele care formează delegaţia Părţii oaspete vor intra pe teritoriul statului Părţii gazdă, dacă Acordul nu stabileşte alt mod; c) bani de buzunar pentru perioada de şedere; d) asigurarea medicală pentru perioada aflării în străinătate; e) documentele necesare, care sunt solicitate de statul Părţii gazdă pentru intrarea, aflarea şi părăsirea teritoriului său. 2. Alte costuri ce reies în rezultatul implementării prezentului Acord în toate domeniile de colaborare, vot fi examinate în baza unui acord special, încheiat între ambele Părţi. Articolul 7
1. Părţile vor asigura protecţia oricărei informaţii, care va fi obţinută în cadrul întrunirilor bilaterale şi în legătură cu implementarea prezentului Acord, în conformitate cu legislaţia internă a statului Părţii, care a primit această informaţie.Protecţia informaţiei 2. Părţile nu vor folosi informaţia obţinută în detrimentul intereselor altei Părţi şi nu vor transmite această informaţie unei terţe Părţi fără consimţământul preliminar în scris al celeilalte Părţi. Articolul 8
Disputele între Părţi, apărute în legătură cu implementarea sau interpretarea prevederilor prezentului Acord, vor fi reglementate de către Părţi prin consultări şi nu vor fi prezentate pentru soluţionare curţilor internaţionale sau terţelor părţi.Reglementarea disputelor Articolul 9
1. Prezentul Acord este încheiat pentru o perioadă nelimitată de timp şi va intra în vigoare la a 60-a zi din data expedierii ultimei notificări de către o Parte celeilalte Părţi, despre îndeplinirea procedurilor interne, necesare pentru intrarea lui în vigoare.Clauze finale 2. La înţelegerea reciprocă a Părţilor în prezentul Acord pot fi introduse modificări şi completări, perfectate în formă de amendamente scrise. Amendamentele vor intra în vigoare potrivit prevederilor paragrafului 1 al articolului 9 al prezentului Acord şi reprezintă o parte inseparabilă a acestuia. 3. Fiecare Parte poate denunţa prezentul Acord pentru o notificare scrisă cu şase luni înainte prezentată celeilalte Părţi. Valabilitatea Acordului expiră la 6 luni din ziua expedierii notificării de denunţare celeilalte Părţi. 4. În cazul expirării valabilităţii Acordului, toate plăţile restante, disputele şi litigiile rămân în vigoare până la soluţionarea lor. Întocmit la Chişinău, la 17 august 2005, în două exemplare originale, fiecare în limbile moldovenească, slovacă şi engleză, toate textele fiind egal autentice. În cazul apariţiei unor divergenţe în interpretarea sau aplicarea prevederilor prezentului Acord, versiunea în limba engleză va prevala. AGREEMENT
Ministry of Defence of the Republic of Moldova and the Ministry of Defence of the Slovak Republic (hereinafter referred to as the Parties),BETWEEN THE MINISTRY OF DEFENCE OF THE REPUBLIC OF MOLDOVA AND THE MINISTRY OF DEFENCE OF THE SLOVAK REPUBLIC ON COOPERATION IN MILITARY AREA coming out from the present military-political situation and effort of countries and international organizations to contribute to the improvement of security and world peace keeping, in effort to create the contracting base in areas of military cooperation between both states, which enhance and improve cooperation, based on full respectation of human rights, sovereignty and equality of both states, in creating a new form of cooperation, understanding and tolerance of Parties, respecting their internal law, international law and customs as well as respecting the Charter of the United Nations and from it resulted peace documents concerning the cooperation in the military area tasks, developing the activities within the framework of PfP Program with the goal integrating into European Security Structures, have agreed on: Article 1
For purposes of interpretation and performing this Agreement, under the term:Definition of terms a) visiting Party is understood the Party, which sends the delegation within its authorization and in concordance with Agreement for visiting the other Party; b) host Party is understood the Party, which admits the delegation of other Party. Article 2
The Parties, guided by the principles of equality, partnership and mutual benefit, will extend and strengthen the cooperation in the following areas:Areas of cooperation 1. The consultation on Armed Safety and military policy tasks, strengthening the security and confidence in world. 2. The exchange of information, views and experiences on army development tasks. 3. The Parties Armed forces structural organization and its documentation. 4. The operation activity in state administration information support and preparation of the territory of state for defense. 5. Qualification and professional requests for classification of the soldiers for position they are supposed to hold. 6. Specialists training of the individual military kinds, their training and education. 7. Exchange of the experiences on military science issues, technical development, service and maintenance of the military equipment. 8. Information and communication systems in the Armed Forces of the Parties. 9. Exchange of the information and experiences in area of housing and investment construction and in area of administration and maintenance of immovable property. 10. Environment protection in military training facilities. 11. Armed Forces activities in peace time and their deployment in case of the extraordinary events. 12. Education in military training facilities. 13. Exchange of the information in area of military - public relations and in area of democratic control over military. 14. Exchange of the information in area of military medical service. 15. Editorial and producer's activities. 16. Security measures for the protection of classified military information. 17. In further areas following mutual agreement of the Parties. Article 3
1. On a base of this Agreement and with the purpose of its implementation, the responsible organs of the Parties will work out separate Protocols of bilateral cooperation.The forms of cooperation 2. The details of bilateral cooperation will be modified as follows: a) the proposals of bilateral cooperation plans for next year will be exchanged by the Parties by 15" November of the running year; b) the proposal approval and final development of the annual plan will be executed by common ad hoc group from both ministries, until 15th December of the running year; c) in each annual plan of bilateral cooperation, the concrete event, form of participation, terms, place where the event will take place and organ which will be responsible for its organization shall be defined; d) the plan proposals and correspondence which are needed for event preparation and its realization will be sent through the regular diplomatic channels. 3. In areas mentioned in Article 2 of this Agreement the cooperation will be realized by following forms: a) meeting of Ministers of Defense of the Parties, chiefs of the General Staffs, commanders or their deputies, or other representatives of both Parties; b) visits of Staff Officers and experts; c) meeting between representatives of military institutions, cooperation between military units; d) reciprocal visits, connected with exhibition of equipment, armaments and military training; e) visits of air force members and other elements of the armed forces; f) lecturers exchange in military educational facilities; g) discussions, consulting, meeting, participation in the courses, symposiums and conferences; h) exchange of newspapers, journals or other press and film production concerning the military issues; i) visits of sport teams and cultural groups. Article 4
The financing of the cooperation which is linked with support of the event in area of military cooperation will be realized on the base of reciprocity and mutual advantageousness in accordance with internal law regulations of the Republic of Moldova and of the Slovak Republic.Financing of the cooperation Article 5
1. The host Party will provide at its own costs for the members of the delegation of the visiting Party:Obligations of the host Party a) accommodation, table, transportation within the territory of the host Party state; b) conference, symposiums and other meetings costs; c) translating services during meetings to language which will be agreed by both Parties; d) cultural program. 2. Host Party will provide for the members of the delegation of the visiting Party: a) urgent and necessary medical care in military or civilian medical facilities under the same conditions as for the nationals of the host Party state; b) necessary coaction in the case of death of a member of the delegation of the visiting Party. Costs for medical documentation and transport of the deceased back to the visiting Party country will by covered by the visiting Party. Article 6
1. The visiting Party will provide at its own costs for the members of the delegation of the visiting Party:Obligations of the visiting Party a) the stay of the members of the delegation on the territory of the host Party state, except the cost borne by the host Party mentioned in Article 5 of this Agreement; b) transportation to the in advance selected place, in which the persons forming the delegation of the visiting Party enter the territory of the host Party state and back, unless the Agreement states otherwise; c) pocket money for a period of staying; d) health insurance of the medical costs abroad; e) necessary documents which are requested by the host Party state to enter its territory, stay there and its departure. 2. Other expenses, which arise as a result of execution of this Agreement in each of the areas of cooperation, will be resolved on a base of an individual agreement concluded between the Parties. Article 7
1. The Parties will provide the protection of every piece of information, which they will receive during bilateral meetings and during the execution of this Agreement, in accordance with internal law regulations of the state of the Party, which received this information.Information protection 2. The Parties will not use the received information against the interests of the other Party and will not hand over this information to a third party without a preliminary written permission of the other Party. Article 8
The disputes that can arise between the Parties during the execution or interpretation of this Agreement will be solved by consultation between the Parties and will not be submitted to none of the international courts or a third party.Settlements of disputes Article 9
1. This Agreement is concluded for unlimited period of time and will enter into force in sixty (60) days after the later date of delivery of the notification by the one Party to the other Party on the completion of the internal procedures necessary for its entering into force.Final provisions 2. The Parties may change or amend this Agreement at any time upon preliminary mutual agreement in the form of written amendments. Amendments come to force in accordance with Article 9 Para 1 of this Agreement and form an inseparable component. 3. Each Party may withdraw from this Agreement at any time by giving six (6) months prior notice of withdrawal in writing to the other Party. The Agreement ceases to be effective in six (6) months after the date of delivery of the withdrawal notice to the other Party. 4. In the event this Agreement ceases to be effective, all outstanding payments, claims and disputes are valid and legitimate until they are finally settled. Done in Chişinău on 17th August 2005 in two original copies each in Moldovan, Slovak and English language, all the texts being equally authentic. In case of divergences of interpretation or implementation of provisions of the Agreement, the English version shall prevail. |
