Am onoarea să Vă informez că am primit scrisoarea Dumneavoastră din 5/9/2003 care comunică următoarele:
„Am onoarea de a mă referi la discuţiile purtate de reprezentanţii celor două guverne privind prezenţa elementelor Forţei Militare în Statul Kuwait ca rezultat al detaşării ei de către Guvernul Republicii Moldova în Statul Kuwait în conformitate cu Rezoluţia corespunzătoare a Consiliului de Securitate.
Urmare a consensului Guvernului Statului Kuwait privind staţionarea acestei forţe pe teritoriul Statului Kuwait, şi intenţionând stabilirea unor relaţii strânse şi durabile între ambele guverne, am onoarea să propun pentru Guvernul Republicii Moldova acest Acord cu privire la statutul Forţei militare a Republicii Moldova în Statul Kuwait în acest scop fiind convenite următoarele:
1. Forţa militară a Republicii Moldova semnifică orice corp, contingent sau detaşament al Armatei Naţionale a Republicii Moldova, care prin consimţământul Guvernului Statului Kuwait este prezent legal în Statul Kuwait şi include angajaţi civili ai Guvernului Republicii Moldova detaşaţi în Statul Kuwait în conformitate cu acest Acord.
2. Forţa militară a Republicii Moldova va respecta legile, regulile, obiceiurile şi tradiţiile din Statul Kuwait şi prin serviciul său nu va fi implicată in afacerile interne din Statul Kuwait.
3. Pe teritoriul său, Statul Kuwait va garanta privilegiile şi imunităţile corpului administrativ şi tehnic în conformitate cu Convenţia de la Viena privind relaţiile diplomatice, din 18 aprilie 1961, efectivului Forţei militare a Republicii Moldova.
4. Antreprenorii, personalul companiilor şi populaţia Statului Kuwait care va activa împreună cu Forţa militară a Republicii Moldova vor fi subiectul legislaţiei Statului Kuweit privind litigiile penale şi civile.
5. a) Ambele guverne vor renunţa la orice pretenţii care pot apărea faţă de celălalt guvern sau faţă de efectivul Forţei militare ale altui guvern pentru traume (inclusiv care au dus la deces) cauzate personalului său, sau pentru distrugere sau pierdere a proprietăţii dacă această traumă, deces sau pierdere a fost cauzată prin acţiuni sau omiteri ale personalului altui guvern în timpul exercitării obligaţiunilor oficiale conform prezentului Acord. Totodată, Forţa militară a Republicii Moldova, va restitui echipamentul şi construcţiile din Statul Kuwait aflate la dispoziţia sa, în aceleaşi condiţii ca la momentul primirii lor şi va compensa orice prejudiciu cauzat prin deteriorare sau pierdere a acestora.
b) Guvernul Statului Kuwait va examina şi soluţiona, în conformitate cu legislaţia sa, pretenţiile a terţe părţi, apărute pe teritoriul său pentru sau în legătură cu orice acţiune sau omitere a Guvernului Republicii Moldova sau a efectivului din Forţa militară a Republicii Moldova în timpul exercitării obligaţiunilor oficiale conform prezentului Acord, care au dus la traumare, deces, pierdere sau deteriorare şi Guvernul Republicii Moldova va achita compensări juste şi rezonabile Guvernului Statului Kuwait pentru aceste pretenţii.
c) Guvernul Republicii Moldova îşi va da străduinţa să aplaneze orice pretenţii ale terţe părţi cauzate de acţiuni sau omiteri ale efectivului Forţei militare a Republicii Moldova care au dus la traume, în afara exercitării obligaţiunilor oficiale conform prezentului Acord şi să obţină satisfacţie pentru orice litigiu apărut în urma acestor pretenţii.
6. Forţa militară a Republicii Moldova poate intra şi părăsi teritoriul Statului Kuwait cu legitimaţii militare sau ale guvernului său. Legitimaţiile militare pentru Statul Kuwait vor fi eliberate de autorităţile locale. Efectivul Forţei militare a Republicii Moldova îşi va perfecta aceste legitimaţii la autorităţile respective ale Guvernului statului Kuwait când va fi necesar.
7. Vehiculele, corăbiile şi aeronavele utilizate de Forţa militară a Republicii Moldova nu sunt subiectul de licenţiere şi înregistrare conform legislaţiei statului Kuwait. Forţa militară a Republicii Moldova poate folosi instalaţiile de aerodrom fără achitarea taxelor. Membrii Forţei militare pot conduce vehicule cu permise de conducere valabile în Republica Moldova.
8. Forţa militară a Republicii Moldova poate importa în Statul Kuwait fără licenţe sau alte restricţii şi fără orice taxe echipament şi alte mijloace logistice necesare pentru operaţiunile sale inclusiv articole personale pentru consum pentru Forţa militară a Republicii Moldova. Pentru orice bunuri importate cu calificativul „DUTYFREE” comercializate în Statul Kuwait pentru persoane care nu au privilegii pentru import conform prezentului paragraf, vor fi aplicate taxe vamale şi de alte genuri conform preţului la data comercializării.
9. Militarii Forţei militare a Republicii Moldova pot purta orice arme, autorizate prin ordinele sale pentru exercitarea obligaţiunilor oficiale.
10. Guvernul Statului Kuwait poate solicita în orice timp retragerea Forţei din Statul Kuwait. Guvernul Republicii Moldova îşi rezervă dreptul de retragere a Forţei militare a Republicii Moldova în orice moment, după notificarea Guvernului Statului Kuwait.
11. Prezentul Acord va intra în vigoare pentru o perioadă de douăsprezece luni şi va fi reînnoit în mod automat pentru perioade similare până când una din Părţi va notifica cealaltă parte intenţia sa de denunţare a prezentului Acord cu şase luni înainte de expirarea lui, însă nu va afecta punctul 5, care va fi implementat indiferent de starea implementării prezentului Acord.
12. Orice dispute, apărute între Părţi privind interpretarea sau implementarea prezentului Acord vor fi aplanate în mod exclusiv prin consultări şi negocieri între Părţi.
13. Prezentul Acord este întocmit în limbile arabă, moldovenească şi engleză, toate textele fiind egal autentice. În caz de divergenţe, textul în limba engleză va prevala.
Am onoarea să propun, că dacă cele menţionate anterior (1-13) sunt acceptabile pentru Guvernul Statului Kuwait, această scrisoare şi răspunsul Dumneavoastră vor constitui un Acord între Guvernele noastre şi va intra în vigoare la data primirii răspunsului Dumneavoastră”.
Am onoarea să Vă informez că Guvernul meu este de acord cu propunerile prezentate în scrisoarea Dumneavoastră. Scrisoarea Dumneavoastră şi prezenta scrisoare de răspuns vor constitui un Acord între Guvernele noastre şi va intra în vigoare la data primirii acestui răspuns.
Cu acest prilej, Excelenţă, primiţi asigurările înaltei mele consideraţiuni.

CONCERNING THE STATUS OF THE
REPUBLIC OF MOLDOVA FORCE IN KUWEIT

I have the honour to acknowledge receipt of your letter dated 5/9/ 2003 which reads as follows:
"I have the honour to refer to discussions which have taken place between representatives of our two Governments regarding the presence of elements of the Armed Force in the State of Kuwait as a result of their deployment by the Government of the Republic of Moldova in the State of Kuwait in accordance with the relevant Security Council Resolutions.
Pursuant to the consent of the Government of the State of Kuwait to the stationing of Thai forces in the territory of the State of Kuwait, and having regard to the close and longstanding ties between our two Governments, I have the honour to propose on behalf of the Government of the Republic of Moldova that an Agreement concerning the status of the Republic of Moldova Force in Kuwait for this purpose be concluded on the following terms:
1. Republic of Moldova Force means any body, contingent or detachment of the Royal Thai Armed Forces , which with the consent of the Government of the State of Kuwait is lawfully present in Kuwait and includes any civilian employee of the Government of the Republic of Moldova sent to Kuwait in connection with this Agreement.
2. The Republic of Moldova Force shall observe and respect the laws, regulations, customs and traditions of Kuwait, and shall have a duty not to interfere in the internal affairs of Kuwait.
3. The Republic of Moldova Force personnel shall be granted by the State of Kuwait on its territory the privileges and immunities of the administrative and technical staff in accordance with the Vienna Convention on Diplomatic Relations of 18 April 1961.
4. Contractors, personnel of companies and Kuwaitis joining the Republic of Moldova Force are subject to Kuwait judicial authority regarding civil and penal matters.
5. (a) Each Government waives any claim it has or may have against the other Government or any personnel from the force of the other Government for injury (including injury resulting in death) suffered by its personnel or for damage to or loss of property owned by it if such injury, death, damage or loss was caused by acts or omissions of personnel of the other Government in the performance of official duties in connection with this Agreement.The Republic of Moldova Force shall, however, submit the equipment and constructions of Kuwait which were under their disposal in the same condition at the time of delivery and to compensate against any damage or loss resulting of the misuse of them.
(b) The Government of Kuwait shall deal with and settle, in accordance with its laws, third party claims arising within its own territory for or in connection with any act or omission by the Government of the Republic of Moldova or any personnel from the Republic of Moldova Force in the performance of official duties in connection with this Agreement which results in injury, death, loss or damage and the Government of the Republic of Moldova will pay just and reasonable compensation to the Government of Kuwait in respect of any such claims.
(c) The Government of the Republic of Moldova shall endeavour to assist third party claims resulting from any act or omission of any personnel from the Republic of Moldova Force causing injury, other than in performance of official duties in connection with this Agreement and in obtaining satisfaction of any judgement obtained in respect of any such claims.
6. The Republic of Moldova Force may enter and exit Kuwait with military or Government identification cards. Kuwaiti military identification cards will be issued by the Kuwaiti authorities. The members of the Republic of Moldova Force shall produce such cards to the appropriate authorities of the Government of Kuwait when required.
7. Vehicles, vessels and aircraft used by the Republic of Moldova Force shall not be subject to licensing or registration under the law of Kuwait.The Republic of Moldova Force may use airfield facilities without payment of dues, tolls or other charges. Members of the Force may operate vehicles with valid Republic of Moldova driving licenses and military identification.
8. The Republic of Moldova Force may import into Kuwait without licence or other restriction and free of customs, duties and taxes, equipment and other supplies required by them for the purpose of their operations together with the personal effects of and items for the personal consumption or use of the Republic of Moldova Force. Any property of any kind imported duty free under this paragraph which is sold in Kuwait to persons other than those entitled to duty free import privileges will be subject to customs and other duties on its value at the time of sale.
9. Military of the Republic of Moldova Force may possess and carry arms when authorised to do so by their orders during their official duties.
10. The Government of Kuwait may at any time request the withdrawal of the Force from Kuwait. The Government of the Republic of Moldova reserves the right to withdraw the Republic of Moldova Force at any time after notifying the Government of Kuwait.
11. This Agreement shall become effective for the period of twelve months and is automatically renewed for similar periods unless either Party notifies the other Party of its intention of terminating this Agreement before its expiration by a period of six months but not to affect paragraph 5 which shall be implemented on any matter which may occur from executing this Agreement.
12. Any dispute between the Parties arising out of the interpretation or implementation of this Agreement shall be settled exclusively by the Parties through consultation and negotiations.
13. This Agreement shall be concluded in the Arabic, Moldovan and English languages, the all texts being authentic. In case of divergence the English text shall prevail.
I have the honour to propose that, if the above terms (1-13) are acceptable to the Government of Kuwait, this letter and your reply will constitute an Agreement between our two Governments which shall take effect on the date of receipt of your reply."
I have the honour to inform you that my Government agrees to the proposals contained in your Letter. Your Letter and the Present Letter of reply there to shall thus constitute an Agreement between our two Governments, which shall take effect on the date of receipt of this reply.
Accept, Excellency, the assurance of my highest consideration.
