    Serviciul Vamal al Republicii Moldova şi Garda Vamală şi Financiară a Republicii Ungare, denumite în continuare Părţi,
    în scopul implementării Protocolului privind asistenţa reciprocă între autorităţile administrative în materie vamală al Acordului de parteneriat şi cooperare dintre Comunităţile Europene şi statele lor membre, pe de o parte, şi Republica Moldova, pe de altă parte, semnat la Bruxelles la 28 noiembrie 1994,
    manifestând interesul în dezvoltarea şi consolidarea cooperării între cele două administraţii vamale şi promovarea eficienţei ambelor instituţii prin schimb reciproc de cunoştinţe şi experienţă,
    fiind convinse că schimbul de informaţie privind procedurile vamale aplicate, inclusiv vămuirea mărfurilor la export şi import, şi informarea reciprocă despre măsurile de soluţionare a problemelor apărute în timpul implementării practice a vămuirii, vor contribui la promovarea comerţului între ambele ţări,
    având în vedere importanţa întreprinderii măsurilor comune, în domeniul lor de autoritate şi competenţă, pentru a preveni orice încălcare a legislaţiei vamale, în vederea protejării intereselor economice ale ambelor ţări,
    considerând importanţa asigurării accesibilităţii legislaţiei lor vamale pentru experţii celeilalte Părţi şi informării reciproce despre implementarea legislaţiei vamale şi rezultatele obţinute în acest domeniu, în scopul procedurilor vamale coordonate şi eficiente,
    luând în considerare că, pe lângă simplificarea procedurilor vamale, instruirea experţilor lor vamali este esenţială pentru îndeplinirea sarcinilor,
    bazându-se pe principiile sus-menţionate,
    au convenit asupra următoarelor:
    1. Părţile se vor informa  reciproc  despre  legislaţia  vamală,  simplificările, armonizările implementate în Republica Moldova şi în Republica Ungară, şi în cazurile de interes comun.
    2. Părţile se vor informa reciproc despre rezultatele profesionale obţinute, metodele aplicate, în special în domeniul simplificării şi armonizării procedurilor vamale.
    3. Părţile vor stabili puncte de contact pentru realizarea obiectivelor concrete.
    4. Părţile vor efectua schimb de cunoştinţe şi experienţă în domeniul vamal.
    5. Părţile se vor consulta asupra dificultăţilor şi neajunsurilor, apărute în timpul implementării practice  a  legislaţiei vamale  şi procedurilor vamale,  asupra soluţiilor şi măsurilor relevante pentru promovarea comerţului bilateral.
    6. Partea Ungară a exprimat disponibilitatea de a împărtăşi experienţa sa, obţinută pe parcursul aderării Republicii Ungare la Uniunea Europeană, cu experţii Părţii moldoveneşti, în scopul promovării armonizării sistemului vamal moldovenesc cu sistemul vamal al Comunităţii.
    7. Conducătorii sau experţii ambelor administraţii vamale se vor întâlni pentru a discuta subiectele şi cazurile de interes comun, în perioada şi în baza agendei convenite reciproc.
Partea ungară a anunţat, că la implementarea prezentului Protocol ea va acţiona în conformitate cu Tratatul de aderare a Republicii Ungare la Uniunea Europeană, semnat la Atena la 16 aprilie 2003, şi legislaţia sa naţională.
    Prezentul Protocol a fost încheiat în baza alineatelor (1) şi (2) ale articolului 14 din Protocolul privind asistenţa reciprocă între autorităţile administrative în materie vamală al Acordului de parteneriat şi cooperare dintre Comunităţile Europene şi statele lor membre, pe de o parte, şi Republica Moldova, pe de altă parte, semnat la Bruxelles la 28 noiembrie 1994.
    Prezentul Protocol intră în vigoare la data semnării.
    Întocmit la Budapesta, la 16 octombrie 2007, în două exemplare originale, fiecare în limbile moldovenească, ungară şi engleză, toate textele fiind egal autentice, în cazul divergenţelor de interpretare, textul în limba engleză va fi de referinţă.

ON COOPERATION BETWEEN THE CUSTOMS

THE CUSTOMS AND FINANCE GUARD OF THE

REPUBLIC OF HUNGARY IN ORDER TO  IMPLEMENT

THE PROTOCOL ON MUTUAL ASSISTANCE

BETWEEN ADMINISTRATIVE AUTHORITIES IN

CUSTOMS MATTERS OF THE PARTNERSHIP AND

COOPERATION AGREEMENT BETWEEN THE EUROPEAN
COMMUNITIES AND THEIR MEMBER STATES, OF THE

ONE PART, AND THE REPUBLIC OF MOLDOVA, OF

THE OTHER PART, SIGNED IN BRUSSELS ON 28 NOVEMBER 1994

    The Customs Service of the Republic of Moldova and the Customs and Finance Guard of the Republic of Hungary, hereinafter referred to as the Parties,
    in order to impîement the Protocol on mutual assistance between administrative authorities in customs matters of the Partnership and Cooperation Agreement between the European Communities and their Member States, of the one part, and the Republic of Moldova, of the other part, signed in Brussels on 28 November 1994;
    showing the interest in development and strengthening the cooperation between the two customs administrations and in promotion the efficiency of the two organizations by mutual exchange of knowledge and experience;
    convinced that the exchange of informat'on regarding the applied customs procedures, including the customs clearance of the export and import of goods and becoming mutually acquainted with measures to solve    
    problems arising during practicai implementation of customs clearance shall assist the promotion of trade between the two countries;
    having regard to the importance of taking common measures within their sphere of authority and competence to prevent any breach of customs legislation in order to protect the two countries' economic interests;
    considering the importance of making availabîe their customs legislation for the experts of the other Party and of mutual informing about the implementation of customs legislation and the results achieved in this field for the purpose of coordinated and effective customs procedures;
    considering that beyond the simplification of customs procedures the training of their customs experts is essential in order to complete the tasks,
    based on the above-mentioned principles,
    have agreed as follows:
     1. The Parties shalî inform each other on the customs legislation, simplifications, harmonisations implemented in the Republic of Moldova and in the Republic of Hungary and on the cases of mutual interest
    2. The Parties shall inform each other about the professional results achieved, the applied methods, especially in the field of the simplification and harmonization of customs procedures.
    3. The Parties shall establish contact points to realize certain tasks.
    4. The Parties shaîl exchange their knowledge and experience in customs matters.
    5. The Parties shall consult about difficulties and objections arisen dunng the practicai implementation of customs legislation and customs procedures, about relevant solutions and measures to promoting bilateral trade.
    6. The Hungarian Party has expressed its readiness to share its experience gained during the accession of the Republic of Hungary to the European Union with the experts of the Moldavian Party in order to promote the harmonization of the Moldavian customs system with the customs system of the Community.
    7. The heads or experts of the two customs administrations shall meet in order to discuss topics and cases of mutual consent at a date and upon an agenda mutually agreed.
    The Hungarian Party has announced that it will proceed in accordance with the Treaty concerning the accession of the Republic of Hungary to the European Union signed in Athens on 16 April 2003 and with its naţional legislation when implementing this Protocol.
    This Protocol has been concluded based on paragraphs (1) and (2) of Article 14 of the Protocol on mutual assistance betvveen administrative authorities in customs matters of the Partnership and Cooperation Agreement between the European Communities and their Member States, of the one part, and the Republic of Moldova, of the other part, signed in Brussels on 28 November 1994.
    This Protocol enters into force on the date of signature.
    Done in  Budapest, on 16 october 2007, in two originalcopies in Moldavian, Hungarian and Engîish languages each, all lexts bemg equally authentic. In case of divergence of interpretation, the English language text shall prevail.
