*În vigoare pentru Republica Moldova din 3 iulie 1997

    Plenipotenţiarii guvernelor ţărilor membre ale Uniunii Poştale Universale, reuniţi în congres la Seul, în baza art. 30 paragraful 2 al Constituţiei Uniunii Poştale Universale, întocmită la Viena la 10 iulie 1964, au adoptat, sub rezerva ratificării, următoarele modificări ale sus-numitei Constituţii.
    1. Ţările membre sau administraţiile lor poştale, dacă legislaţia acestor ţări nu se opune, pot stabili uniuni restrînse şi pot lua parte la aranjamente speciale privind serviciul poştal internaţional, cu condiţia, totuşi, să nu introducă prin aceasta dispoziţii mai puţin favorabile pentru public faţă de cele prevăzute prin actele la care ţările membre interesate sunt participante.
    2. Uniunile restrînse pot trimite observatori la congresele, conferinţele şi reuniunile Uniunii, la Consiliul de administraţie, precum şi la consiliul de exploatare poştală.
    3. Uniunea poate trimite observatori la congresele, conferinţele şi reuniunile uniunilor restrînse.
    1. Organele Uniunii sunt Congresul, Consiliul de administrare, Consiliul de exploatare poştală şi Biroul internaţional.
    2. Organele permanente ale Uniunii sunt consiliul de administraţie, Consiliul de exploatare poştală şi Biroul internaţional.
    1. Între două congrese, Consiliul de administraţie (C.A.) asigură continuitatea lucrărilor Uniunii, conform dispoziţiilor actelor Uniunii.
    2. Membrii Consiliului de administraţie îşi exercită funcţiile în numele şi în interesul Uniunii.
    Consiliul de exploatare poştală (C.E.P.) este însărcinat cu problemele de exploatare, comerciale, tehnice şi economice, care interesează serviciul poştal.
    Un oficiu central, care funcţionează în sediul Uniunii sub denumirea de Biroul internaţional al Uniunii Poştale Universale, condus de către un director general şi plasat sub controlul Consiliului de administraţie, serveşte drept organ de execuţie, sprijin, legătură, informare şi consultare.
    1. Constituţia este actul fundamental al Uniunii. Ea conţine regulile organice ale Uniunii.
    2. Regulamentul general comportă dispoziţiile care asigură aplicarea Constituţiei şi funcţionarea Uniunii. El este obligatoriu pentru toate ţările membre.
    3. Convenţia poştală universală şi regulamentul ei de aplicare comportă regulile comune aplicabile serviciului poştal internaţional şi dispoziţiile privind serviciile poştei de scrisori. Aceste acte sunt obligatorii pentru toate ţările membre.
    4. Aranjamentele Uniunii şi regulamentele de aplicare a lor reglementează alte servicii decît cele ale poştei de scrisori între ţările membre care sunt părţi la aranjament. Ele nu sunt obligatorii decît pentru aceste ţări.
    5. Regulamentele de aplicare, care conţin măsurile de aplicare necesare executării convenţiei şi aranjamentelor, sunt decise de către Consiliul de exploatare poştală, ţinîndu-se seama de hotărîrile luate de către Congres.
    6. Protocoalele finale eventuale, anexate actelor Uniunii, vizate în paragrafele 3, 4 şi 5, conţin rezerve la aceste acte.
    1. Actele Uniunii adoptate de Congres sunt semnate de către plenipotenţiarii ţărilor membre.
    2. Regulamentele de aplicare sunt autentificate de către preşedintele şi secretarul general al Consiliului de exploatare poştală.
    3. Constituţia este ratificată, de îndată ce este posibil, de către ţările semnatare.
    4. Aprobarea actelor Uniunii, altele decît Constituţia, este guvernată de către regulile constituţionale ale fiecărei ţări semnatare.
    5. Cînd o ţară nu ratifică Constituţia sau nu aprobă celelalte acte semnate de ea, Constituţia şi celelalte acte nu sunt mai puţin valabile pentru ţările care le-au ratificat sau le-au aprobat.
    1. Ţările membre care nu au semnat prezentul protocol pot să adere oricînd la el.
    2. Ţările membre care sunt părţi la actele reînnoite de către Congres, dar care nu le-au semnat, sunt obligate să adere la ele în cel mai scurt timp posibil.
    3. Instrumentele de aderare referitoare la cazurile vizate în paragrafele 1 şi 2 trebuie să fie adresate directorului general al Biroului internaţional. Acesta notifică guvernelor ţărilor membre respectiva depunere.
    Prezentul Protocol adiţional va fi pus în aplicare la 1 ianuarie 1996 şi va rămîne în vigoare pe timp nedeterminat.
    Drept pentru care, plenipotenţiarii guvernelor ţărilor membre au redactat prezentul Protocol adiţional, care va avea aceeaşi forţă şi aceeaşi valoare ca şi cînd dispoziţiile sale ar fi inserate în însuşi textul Constituţiei; ei l-au semnat într-un exemplar care este depus pe lîngă directorul general al Biroului internaţional. O copie va fi remisă fiecărei părţi de către guvernul ţării gazdă a Congresului.

    The plenipotentiaries of the Governments of the member countries of the Universal Postal Union, met in Congress at Seoul, in view of article 30, paragraph 2, of the Constitution of the Universal Postal Union concluded at Vienna on 10 July 1964, have adopted, subject to ratification, the following amendments to that Constitution.
    1. Member Countries, or their Postal Administrations if the legislation of those Countries so permits, may establish Restricted Unions and take part in Special Agreements concerning the international postal service, provided always that they do not introduce provisions less favourable to the public than those provided for by the Acts to which the Member Countries concerned are parties.
    2. Restricted Unions may send observers to Congresses, Conferences and meetings of the Union, to the Administrative Council and to the Council for Postal Studies.
    3. The Union may send observers to Congresses, Conferences and meetings of Restricted Unions.
    1. The organs of the Union are Congress, the Administrative Council, the Council for Postal Studies, and the International Bureau.
    2. The permanent organs of the Union are the Administrative Council, the Council for Postal Studies and the International Bureau.
    1. Between Congresses the Administrative Council (AC) ensures the continuity of the work of the Union in accordance with the provisions of the Acts of the Union.
    2. Members of the Administrative Council carry out their functions in the name and in the interest of the Union.
    The Council for Postal Studies (CPS) is entrusted with carrying out the issues on exploatation, commercial, technical and economic questions concerning the postal service.
    A central office operating at the seat of the Union under the title of the International Bureau of the Universal Postal Union, directed by a Director General and placed under the general supervision of the Administrative Council, serves as an organ of execution, sustainance, liaison, information and consultation.
    1. The Constitution is the basic Act of the Union. It contains the organic rules of the Union.
    2. The General Regulations embody those provisions which ensure the application of the Constitution and the working of the Union. They shall be binding on all Member Countries.
    3. The Universal Postal Convention and its Detailed Regulations embody the rules applicable throughout the international postal service and the provisions concerning the letter post services. These Acts shall be binding on all Member Countries.
    4. The Agreements of the Union, and their Detailed Regulations, regulate the services other than those of the letter post between those Member Countries which are parties to them. They shall be binding on those Countries only.
    5. The Detailed Regulations, which contain the rules of application necessary for the implementation of the Convention and of the Agreements, shall be drawn up by the Council for Postal Studies, taking into consideration the decisions of the Congress.
    6. The Final Protocols annexed to the Acts of the Union referred to in SSSS 3, 4 and 5 contain the reservations to those Acts.
    1. The Acts of the Union adopted by the Congress shall be sign by Plenipotentiaries.
    2. The Detailed Regulations shall be authenticated by theChairmen and the Secretary-General of Council for Postal Studies.
    3. The Constitution shall be ratified as soon as possible by the signatory Countries.
    4. Approval of the Acts of the Union other than the Constitution is governed by the constitutional regulations of each signatory Country.
    5. When a Country does not ratify the Constitution or does not approve the other Acts which it has signed, the Constitution and the other Acts shall be no less valid for the other Countries that have ratified or approved them.
    1. Member countries which have not signed the present Protocol may accede to it at any time.
    2. Member countries which are party to the Acts renewed by Congress but which have not signed them shall accede thereto as soon as possible.
    3. Instruments of accession relating to the cases set forth in paragraphs 1 and 2 shall be sent to the Director-General of the International Bureau, who shall notify the Governments of the member countries of their deposit.
    This Additional Protocol shall come into force on 1 January 1996 and shall remain in force for an indefinite period.
    In witness whereof the plenipotentiaries of the Governments of the member countries have drawn up this Additional Protocol, which shall have the same force and the same validity as if its provisions were inserted in the text of the Constitution itself, and they have signed it in a single original which shall be deposited with the Director-General of the International Bureau. A copy thereof shall be delivered to each party by the Government of the country in which Congress is held.
